Terms of Service

These terms are a contract between you and Adaptive Systems Group LLC and its operating subsidiary Talktuit LLC (we, us, our) and govern your use of the TalkTuit™ website and service. By using the service you agree to them. This is a strong standard template for launch. Have your attorney review and finalize it before you rely on it at scale.

1. The service

TalkTuit™ provides AI powered inbound call answering, lead capture, and related CRM features. Features and plans may change as the product evolves.

2. Plans, billing, and cancellation

Paid plans are billed monthly after a one time onboarding fee, month to month unless otherwise agreed in writing. Subscriptions renew automatically until you cancel. You may cancel anytime and your plan ends at the close of the current billing period. Onboarding fees are non refundable once work has begun. Prices may change with notice.

3. Your responsibilities

You are responsible for the accuracy of the information you provide, for how you use the leads and data we deliver, and for obtaining any consent required in your area to record, route, or message your callers. You agree to use the service only for lawful purposes and not to misuse, copy, or interfere with it.

4. AI disclaimer

The service uses artificial intelligence and automated voice. It will not be perfect and may occasionally misunderstand a caller or make an error. The service is a safety net that supplements your team and is not a guarantee of any specific result, booking, or amount of revenue.

5. Intellectual property

The TalkTuit™ name, logo, software, and content are owned by Adaptive Systems Group LLC and protected by law. TalkTuit™ is a trademark of Adaptive Systems Group LLC. We grant you a limited, revocable right to use the service. You keep ownership of your own business data.

6. Limitation of liability

The service is provided as is and as available. To the fullest extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the fees you paid in the month before a claim arose.

7. Indemnification

You agree to cover claims that arise from your use of the service or your violation of these terms or of any law, including caller consent and messaging laws.

8. Governing law and disputes

These terms are governed by the laws of the State of Ohio, without regard to its conflict of law rules. Disputes will be handled in the state or federal courts located in Ohio, unless we agree otherwise in writing.

9. Changes

We may update these terms and will change the date above when we do. Continued use means you accept the updated terms.
